1. About These Terms
These Terms govern your use of the OpenMindAI desktop and mobile applications, the OpenMindAI website, documentation, optional network-enabled services, connected applications, model-management functionality, update mechanisms, support channels, and related OpenMindAI-operated features.
OpenMindAI is a local-first artificial intelligence platform. Some functions run entirely or primarily on your own device. Other functions intentionally use internet-connected services.
These Terms should be read together with the OpenMindAI Privacy Policy and with any separate license, model card, open-source notice, service agreement, or third-party terms that apply to a specific component.
If a separate open-source license grants you rights in source code or binaries, those rights are governed by that license and are not taken away by these Terms.
2. Acceptance of These Terms
By downloading, installing, opening, accessing, or using OpenMindAI, you agree to these Terms to the extent permitted by applicable law.
If you do not agree, do not use network-enabled OpenMindAI services and discontinue use of any component for which acceptance of these Terms is legally required.
For open-source components, your rights to use, reproduce, modify, or redistribute the software may arise independently under the applicable open-source license even if you do not accept separate service-related terms.
If you use OpenMindAI on behalf of a company, university, school, research institution, government body, nonprofit organization, employer, customer, or other entity, you represent that you have authority to use the software and any connected resources on that entity's behalf.
The organization remains responsible for its own security, compliance, privacy, procurement, data-governance, retention, monitoring, and acceptable-use requirements.
3. Who May Use OpenMindAI
You must have the legal capacity required in your jurisdiction to agree to these Terms or use OpenMindAI with any consent, supervision, or authorization required by law.
You are responsible for ensuring that you are authorized to access every file, repository, account, device, API, database, network, document, camera, microphone, storage location, connected application, or other resource you use through OpenMindAI.
OpenMindAI does not grant you permission to access resources that you are otherwise prohibited from accessing.
If an organization deploys OpenMindAI to employees, students, contractors, researchers, or other users, that organization is responsible for deciding whether the software is appropriate for its environment.
4. What OpenMindAI Provides
OpenMindAI may provide local AI chat, text generation, reasoning, Search, Deep Research, document analysis, image understanding, voice input, spoken responses, model management, local model execution, project workspaces, local agents, local file tools, connected applications, artifact generation, media workflows, personalization, updates, and related AI-assisted functionality.
Capabilities can differ by platform, hardware, model, operating system, permissions, region, runtime, release version, or distribution channel.
A feature shown in documentation does not guarantee that it is available on every device.
OpenMindAI may improve, replace, rename, add, restrict, deprecate, or remove features where reasonably necessary for technical, licensing, legal, security, safety, performance, product-development, or platform-policy reasons.
5. Local-First and Online Features
OpenMindAI is designed to run useful AI locally whenever the selected model and runtime support local execution.
Normal local Chat, local reasoning, local conversation history, local document analysis, local Projects, supported local vision, local voice features, local model management, and related local workflows can operate without a continuous cloud AI connection after required components are installed.
Other functions require network access.
Examples include model downloads, runtime downloads, software updates, Search, Deep Research, GitHub, Google Workspace, Microsoft 365, Slack, Notion, Dropbox, MCP servers, Firebase Analytics on mobile, support channels, and other external services.
Using OpenMindAI therefore does not mean that all data always remains local.
The Privacy Policy explains the difference between local processing and remote processing in more detail.
6. Open-Source License and Apache 2.0
OpenMindAI includes software distributed under open-source licenses.
The current OpenMindAI desktop repository and current OpenMindAI Mobile license asset include the Apache License, Version 2.0.
Where Apache License 2.0 applies, the rights granted by that license are governed by the Apache License itself.
Those rights can include, subject to the license terms, rights to use, reproduce, prepare derivative works, publicly display, sublicense, and distribute the covered Work.
Nothing in these Terms is intended to:
- revoke rights that the Apache License 2.0 states are irrevocable;
- prohibit modification or redistribution that the Apache License permits;
- impose a conflicting restriction on rights granted by an applicable open-source license;
- remove required notices or attribution obligations under an applicable open-source license.
These Terms separately govern matters such as official OpenMindAI branding, optional online services, connected accounts, support, user conduct, AI-generated content, store distribution, and use of services or materials that are not licensed under Apache 2.0.
If a conflict exists between these Terms and a valid open-source license for a particular component, the open-source license controls for that component.
7. OpenMindAI Branding and Official Releases
Open-source licensing of software code does not automatically grant unrestricted rights to OpenMindAI trademarks, logos, product identity, official-release representations, store listings, or brand assets.
You must not falsely claim that a modified build is an official OpenMindAI release.
You must not use OpenMindAI branding in a way that is deceptive, fraudulent, confusing, or likely to imply sponsorship or endorsement that does not exist.
You may accurately describe compatibility, forks, modifications, or derivation where permitted by applicable law and license terms, provided your description is not misleading.
Official distribution channels may use digital signatures, package identities, checksums, release tags, store publisher identities, or other mechanisms to distinguish official builds from third-party builds.
8. User Content
"User Content" includes prompts, messages, documents, files, images, audio, source code, configuration, project folders, instructions, local knowledge, repository content, and other information you choose to provide to OpenMindAI.
As between you and OpenMindAI, you retain the rights you already hold in your User Content.
OpenMindAI does not claim ownership merely because your content is processed by the application.
You are responsible for making sure you have the legal right and authority to use that content.
This is especially important for confidential business information, personal data, copyrighted material, customer records, source code, trade secrets, unpublished research, medical information, financial records, regulated data, or content subject to nondisclosure obligations.
When a workflow runs locally, OpenMindAI generally does not need a remote license to your User Content simply for on-device processing.
When you intentionally use a network-enabled feature, you authorize transmission and processing only as reasonably necessary to provide that selected feature, subject to the Privacy Policy and any relevant third-party terms.
9. AI-Generated Output
"Generated Output" includes text, code, explanations, summaries, images, structured data, recommendations, documents, analyses, transformations, and other content produced using AI through OpenMindAI.
Rights in Generated Output can depend on applicable law, model license, source material, your contribution, third-party rights, and the nature of the output.
OpenMindAI does not guarantee that Generated Output:
- is copyrightable;
- is unique;
- is exclusive to you;
- is free from third-party rights;
- is factually correct;
- is suitable for commercial use;
- satisfies a regulator, publisher, employer, academic institution, or customer.
Different users or models may produce similar or identical output.
You are responsible for reviewing output before publishing, filing, deploying, selling, submitting, distributing, or relying on it.
10. AI Accuracy and Hallucinations
AI systems can generate confident but incorrect information.
OpenMindAI models may misunderstand prompts, fabricate details, generate outdated information, misinterpret documents, produce insecure code, make mathematical errors, or incorrectly describe a visual input.
Search and Deep Research can provide current external information, but retrieval does not guarantee accuracy or completeness.
You must independently verify important information before relying on it.
OpenMindAI is an assistance tool, not a guarantee of truth.
11. Professional and High-Impact Use
OpenMindAI is not a substitute for qualified professional judgment.
Do not rely solely on AI-generated content for medical diagnosis or treatment, legal representation, financial investment decisions, tax advice, safety-critical engineering, critical infrastructure, emergency response, employment decisions, credit decisions, insurance eligibility, criminal justice, or other high-impact decisions.
Where applicable law requires a licensed professional, human decision maker, formal validation, certified process, or regulated system, OpenMindAI does not replace that requirement.
Users remain responsible for implementing appropriate human review.
12. Coding and Software Engineering Use
OpenMindAI can help explain, generate, modify, review, or debug source code.
AI-generated code can contain vulnerabilities, licensing issues, hidden dependencies, logic errors, insecure defaults, destructive commands, or incompatible changes.
Before deploying AI-assisted code, review it, run appropriate tests, perform security checks, confirm dependency licenses, and validate behavior in an appropriate environment.
Do not allow AI-generated code or commands to be automatically deployed to production systems without the controls appropriate to your organization.
13. Projects, Local Agents, and File Access
OpenMindAI desktop Projects can be linked to local folders.
A Local Project Agent may inspect files, read source code, create or modify files, rename or delete scoped files, review Git information, run validation, and perform related work according to the permissions you grant.
You are responsible for choosing an appropriate workspace.
Use the smallest practical folder scope.
Do not grant access to an entire disk or sensitive directory merely for convenience when the task only needs one project.
Before allowing an agent to modify important files, use version control or maintain a backup.
14. Upcoming OpenMindAI Code Agent
OpenMindAI may introduce a dedicated Code Agent for deeper software-development workflows.
Planned capabilities can include project-aware reasoning, multi-file analysis, code generation, refactoring, debugging, testing, Git-aware review, validation, and approved command execution.
An upcoming or preview feature is not guaranteed to ship in a particular release or on a particular date.
The Code Agent will remain subject to these Terms, project permissions, user authorization, applicable model licenses, security controls, and any feature-specific terms presented when the capability becomes available.
You remain responsible for reviewing every consequential code change.
15. Terminal and Full-PC Permissions
Terminal access and broader filesystem access are more sensitive than ordinary Chat.
OpenMindAI separates ordinary AI use from broader execution permissions.
Where Full PC + Terminal or a similar capability is available, you must explicitly authorize it before the application can use that permission path.
Command execution can affect files, repositories, dependencies, networks, services, and system state.
You are responsible for ensuring that you have permission to run the command and that the environment is safe for automated or AI-assisted execution.
OpenMindAI may apply timeouts, command limits, output limits, failure budgets, duplicate-action protection, validation requirements, and other safeguards.
Those safeguards reduce risk but cannot guarantee that every command is safe.
16. Research and Academic Use
OpenMindAI can assist with research, literature exploration, writing, analysis, coding, summarization, and technical reasoning.
You are responsible for complying with the academic-integrity, authorship, disclosure, citation, research-ethics, data-governance, and AI-use rules that apply to your institution, publisher, funder, conference, journal, or research project.
AI-generated citations can be incorrect or fabricated.
Always verify references against original sources before publication or submission.
Do not represent AI-generated analysis as independently verified experimental evidence.
17. Acceptable Use
You may use OpenMindAI for lawful personal, educational, research, development, professional, and business purposes, subject to applicable law, applicable model licenses, connected-service terms, and these Terms.
Your use must respect the rights, safety, security, and privacy of others.
You are responsible for activity initiated from your device, credentials, connected accounts, and authorized workspaces.
18. Prohibited Uses
You must not use OpenMindAI to engage in unlawful activity or intentionally facilitate activity that is unlawful in the applicable jurisdiction.
Examples of prohibited or restricted conduct include using OpenMindAI to:
- exploit, abuse, sexualize, groom, traffic, or endanger children;
- generate or distribute non-consensual intimate imagery;
- facilitate fraud, impersonation, phishing, identity theft, extortion, or scams;
- create deceptive official documents or credentials for dishonest use;
- gain unauthorized access to accounts, systems, networks, or data;
- deploy malware, ransomware, destructive payloads, credential theft, or unauthorized persistence;
- meaningfully facilitate violent wrongdoing where prohibited by law;
- stalk, harass, threaten, intimidate, or unlawfully surveil another person;
- violate intellectual-property rights knowingly or systematically;
- bypass access controls or security measures without authorization;
- interfere with OpenMindAI services, distribution infrastructure, or other users;
- use connected accounts beyond the permissions granted by the account owner;
- misrepresent AI-generated output as verified human or professional judgment when that misrepresentation is unlawful or materially deceptive.
Nothing in this section prohibits legitimate defensive cybersecurity, authorized testing, research, interoperability, or other lawful activity.
19. AI Content Safety and Reporting
OpenMindAI contains generative AI features.
Where required by an application store or applicable law, OpenMindAI may provide an in-app or linked mechanism for reporting inappropriate AI-generated content.
User reports may be reviewed to investigate product-safety issues, improve safeguards, identify abuse patterns, or comply with platform requirements.
A local model can sometimes produce content that OpenMindAI did not intend.
The presence of a local model does not remove the user's responsibility to use generated content lawfully.
Google Play currently requires covered generative AI applications to provide an in-app mechanism for users to flag or report offensive AI-generated content.
Microsoft Store policy also requires products with live generative AI content to provide a way for users to report inappropriate generated content.
OpenMindAI releases distributed through those stores must implement the required reporting flow.
20. Security and Authorized Access
You must use OpenMindAI only on systems, files, repositories, networks, and accounts you are authorized to access.
Do not use a local agent, Code Agent, terminal tool, connected app, or other OpenMindAI capability to exceed your own authorization.
Keep passwords, access tokens, API keys, private keys, and other secrets secure.
Do not paste secrets into ordinary prompts unless the task genuinely requires them and you understand where the selected feature processes its input.
OpenMindAI may refuse, restrict, or disable remote functionality where necessary to address abuse, security threats, platform-policy obligations, or legal requirements.
21. Third-Party AI Models
OpenMindAI can use or help users obtain third-party or open-weight AI models.
Those models may be subject to their own licenses, acceptable-use policies, model cards, attribution requirements, geographic restrictions, commercial-use restrictions, or other conditions.
The fact that a model is technically compatible with OpenMindAI does not mean OpenMindAI owns that model or has authority to modify its license.
You are responsible for reviewing the model terms that apply to your intended use.
OpenMindAI may rename a model in the user interface for product usability while preserving upstream provenance internally where appropriate.
Such naming does not transfer ownership of the underlying model.
22. Third-Party Software and Open-Source Components
OpenMindAI uses third-party software, frameworks, libraries, codecs, runtimes, and other open-source components.
Those components remain subject to their respective licenses and notices.
Third-party license obligations can include attribution, notice preservation, source availability, patent terms, redistribution conditions, or copyleft obligations.
When redistributing a modified OpenMindAI build, you are responsible for satisfying all licenses that apply to the components you distribute.
23. Model Downloads and Model Licenses
AI model files can be large.
You are responsible for having sufficient network bandwidth, device storage, memory, and hardware capability before downloading or using them.
OpenMindAI may verify downloaded files using checksums or metadata where available.
Verification helps detect incomplete or corrupted files but does not certify that a model is safe, lawful, accurate, or suitable for your intended purpose.
A model download may be hosted by a third party.
That host may receive normal network information, including your IP address and requested file.
24. Connected Apps and External Services
Connected applications are optional.
If you connect an external account, OpenMindAI may access or send information as needed to perform the request you initiate and as permitted by the authorization scope you approve.
Third-party providers process data under their own terms and privacy policies.
OpenMindAI is not responsible for the independent availability, security, policy changes, service interruptions, or account actions of third-party providers except to the extent required by law.
Disconnect an integration if you no longer want OpenMindAI to access it.
25. GitHub, Google, Microsoft, Slack, Notion, Dropbox, and MCP
OpenMindAI may support integrations with GitHub, Google Workspace, Microsoft 365, Slack, Notion, Dropbox, and MCP-compatible servers.
A provider's name in OpenMindAI identifies a technical integration and does not imply endorsement or ownership.
You must follow the provider's terms.
For MCP servers, review the server operator, permissions, and security before enabling access.
An MCP server may expose sensitive actions or data.
Do not connect an untrusted MCP server to confidential resources.
26. Privacy
Your use of OpenMindAI is also governed by the OpenMindAI Privacy Policy.
The Privacy Policy explains local processing, remote processing, mobile analytics, Search, Research, connected apps, device permissions, retention, deletion, security, and privacy rights.
Privacy Policy:
https://www.openmindai.org/privacy
If the final public privacy page uses another path, this link should be updated before release.
27. Device Permissions
OpenMindAI may request access to device resources when a feature needs them.
The current mobile application declares or describes capabilities including Internet, Camera, Microphone, Notifications, Biometrics/Face ID, and iOS Photo Library access.
Core text Chat does not require Camera or Microphone access.
Granting one permission does not authorize unrelated use.
You can normally revoke sensitive permissions through your operating-system settings.
Some features will stop working after the relevant permission is revoked.
28. Local Storage and User Data
Local-first operation means important OpenMindAI data can be stored only on your device.
You are responsible for maintaining appropriate device security and backups.
OpenMindAI does not guarantee recovery of local data after device failure, disk corruption, accidental deletion, operating-system reset, external-drive loss, or unsupported manual changes to the data directory.
On desktop, model files and application data may live on a storage root selected by the user.
On mobile, models and durable attachment copies can use application-private storage.
29. Internet Connectivity and Data Charges
Some features require internet access.
Your network provider may charge for data usage.
Large models can require hundreds of megabytes or several gigabytes of downloads.
You are responsible for mobile data, roaming, ISP, bandwidth, and related charges.
OpenMindAI does not guarantee that every remote provider will remain reachable from every country or network.
30. Updates and Maintenance
OpenMindAI may provide application updates, security fixes, model-catalog changes, runtime updates, compatibility improvements, or maintenance releases.
Some updates may be necessary to maintain security or compatibility.
OpenMindAI may stop supporting an old release after a reasonable transition period where technically, legally, or operationally necessary.
Open-source licensing may allow you to continue using older code or builds independently, but OpenMindAI is not required to provide indefinite online-service compatibility for every historical release.
31. Availability and Feature Changes
OpenMindAI does not guarantee uninterrupted availability of every feature.
Local capabilities can depend on hardware, model files, runtime compatibility, storage, and operating-system behavior.
Remote capabilities can depend on third-party providers, network connectivity, service limits, API changes, policy changes, or outages.
Features may change over time.
Documentation is descriptive and may be updated after product changes.
32. Beta, Preview, and Experimental Features
Some features may be labeled Beta, Preview, Experimental, Early Access, or similar.
Those features may be incomplete, less stable, subject to change, or removed.
Do not use experimental features for safety-critical or production-critical workflows unless you have independently validated them.
An experimental label does not remove applicable privacy, security, or consumer-law obligations.
33. Support
OpenMindAI may provide documentation, issue tracking, community support, or direct support channels.
Unless a separate paid support agreement exists, support is provided on a reasonable-effort basis without a guaranteed response or resolution time.
Do not submit passwords, private keys, access tokens, or unnecessary sensitive data through public support channels.
Public GitHub issues can be visible to anyone.
34. Accounts and Credentials
Local OpenMindAI use may not require an OpenMindAI cloud account.
Connected third-party services can require external accounts.
You are responsible for keeping account credentials secure.
If you authorize OpenMindAI to access a third-party account, that access is limited by the provider authorization and OpenMindAI implementation.
You should revoke unused connections.
35. Fees, Subscriptions, and Paid Features
OpenMindAI local functionality may be distributed without a recurring AI API requirement.
However, OpenMindAI may introduce optional paid products, support, services, subscriptions, storage, premium features, or third-party integrations in the future.
No charge should apply unless the price and payment obligation are disclosed before purchase.
If a store processes the transaction, the store's billing, cancellation, tax, and refund rules may also apply.
Mandatory consumer refund rights are not waived by these Terms.
Third-party services may charge independently.
36. Advertising and Sponsorship
OpenMindAI is not currently described as an advertising-driven AI product in these Terms.
If OpenMindAI later introduces advertising or sponsored content, the application and Privacy Policy must clearly distinguish it from ordinary AI-generated content where required.
Any advertising implementation must comply with applicable law and application-store rules.
These Terms must be updated before a materially different advertising business model is introduced if that change affects users' rights or obligations.
37. Intellectual Property Complaints
If you believe content distributed through an OpenMindAI-operated online service infringes your intellectual-property rights, contact OpenMindAI through the official contact channel.
Include enough information to identify the material and explain your rights.
OpenMindAI cannot remotely remove local-only content that exists exclusively on another user's device and was never transmitted to an OpenMindAI-controlled service.
Third-party services have their own intellectual-property complaint processes.
38. Trademarks and Third-Party Names
OpenMindAI may refer to third-party companies, models, libraries, hardware platforms, operating systems, or services for compatibility and technical identification.
All third-party trademarks remain the property of their respective owners.
Reference to a third party does not imply partnership, sponsorship, endorsement, certification, or affiliation unless expressly stated.
39. Export Controls and Sanctions
OpenMindAI, third-party models, encryption technology, software components, or connected services may be subject to export-control, trade-control, or sanctions laws.
You are responsible for complying with laws that apply to your location, destination, organization, and intended use.
OpenMindAI may restrict certain online distribution or service access where required by law.
This does not necessarily limit open-source rights that independently apply to lawfully obtained software, except where applicable law itself imposes restrictions.
40. Accessibility
OpenMindAI aims to provide usable interfaces across desktop and mobile platforms.
Accessibility can vary by operating system, release, device, and feature.
If accessibility support is required by applicable law or procurement requirements, organizations should evaluate the actual released application against those requirements before deployment.
OpenMindAI welcomes accessibility feedback through the official contact channel.
41. Children and Younger Users
OpenMindAI is a general-purpose AI productivity application and is not intended as a child-directed social or entertainment service.
Where a child or minor lacks legal capacity to accept these Terms independently, use must occur with the consent or supervision required by applicable law.
Parents, guardians, schools, and organizations are responsible for determining whether local AI use is appropriate for a younger user.
OpenMindAI must comply with application-store child-safety rules when distributed through those platforms.
42. Mobile Application Terms
Mobile devices have stricter memory, battery, storage, background-execution, and thermal limits than desktop computers.
OpenMindAI does not guarantee that every model will run on every phone or tablet.
You are responsible for choosing models suitable for your hardware.
Local inference may increase battery use and device temperature.
The operating system may suspend, throttle, or terminate heavy workloads.
OpenMindAI Mobile may use system file pickers, app-private storage, notifications, Camera, Microphone, Photo Library, and Biometrics according to the relevant feature and permission.
43. Desktop Application Terms
Desktop OpenMindAI can expose more powerful local capabilities than mobile, including Projects, local file access, Project Agents, connected apps, artifact generation, model/runtime management, and optional terminal access.
You are responsible for using those capabilities only inside authorized environments.
OpenMindAI should not be run with unnecessary elevated operating-system privileges.
Use version control and backups before permitting automated modification of important projects.
44. Microsoft Store Distribution
If OpenMindAI is distributed through Microsoft Store, Microsoft Store terms and policies also apply to that distribution relationship.
OpenMindAI remains responsible for the product and its content except where Microsoft has obligations under applicable platform terms or law.
Microsoft Store currently requires products containing live generative AI content to disclose that generative AI is used, declare that use during submission, ensure generated content complies with Store policy, and provide users a way to report inappropriate generated content.
Nothing in these Terms removes mandatory rights provided by Microsoft Store, Microsoft account terms, or applicable consumer law.
45. Google Play Distribution
If OpenMindAI is distributed through Google Play, Google Play terms and the Google Play Developer Program Policies apply to the distribution.
Google Play currently requires covered generative AI applications to comply with its AI-generated content rules and to provide an in-app user reporting or flagging mechanism for offensive AI-generated content.
Google Play also applies user-data requirements to third-party AI integrations.
OpenMindAI must keep its Data Safety disclosure, Privacy Policy, permissions, analytics behavior, and actual application data flow consistent.
Refunds, purchases, subscriptions, and billing processed by Google Play are additionally governed by applicable Google Play terms.
46. Apple App Store Distribution
If OpenMindAI is distributed through Apple's App Store, these Terms are between you and the OpenMindAI developer, not Apple.
OpenMindAI, not Apple, is responsible for the application and its content, except for obligations Apple separately assumes under its own agreements or applicable law.
Any license for an App Store distributed copy is subject to the usage rules permitted by Apple's current media-services terms, while rights granted by applicable open-source licenses remain unaffected.
Apple has no obligation to provide maintenance or support for OpenMindAI except to the extent required under Apple's own terms or applicable law.
To the extent required by Apple's minimum EULA terms, OpenMindAI is responsible for product warranties, product claims, intellectual-property infringement claims, and support obligations attributable to the application.
You represent that your use of the application will comply with applicable third-party terms and applicable trade-control law.
Apple and its subsidiaries are intended third-party beneficiaries of the App Store-specific provisions of these Terms to the extent required by Apple's developer distribution terms and may enforce those provisions as permitted by those terms.
If Apple changes its required minimum EULA terms, the App Store version of these Terms should be updated accordingly.
47. Other Distribution Channels
OpenMindAI may also be distributed through direct downloads, Linux packages, enterprise deployment, alternative Android stores, or other authorized channels.
Those channels may impose additional rules.
Where a distribution-channel rule conflicts with these Terms, mandatory platform or consumer-law requirements apply to the extent legally required.
Unofficial third-party builds are not supported as official OpenMindAI releases merely because they contain OpenMindAI-derived source code.
48. Backups and Data Loss
OpenMindAI can store important information locally.
Local-first architecture means some data may exist only on your device.
You are responsible for maintaining backups appropriate to the importance of your work.
OpenMindAI is not a backup service unless a separate backup feature explicitly states otherwise.
Do not assume that uninstalling, moving storage, deleting a model, changing an external drive, or resetting a device can always be reversed.
49. Suspension of Online Features
OpenMindAI may suspend or restrict online services where reasonably necessary for security, abuse prevention, legal compliance, platform-policy compliance, maintenance, provider outages, or technical limitations.
Suspension of an OpenMindAI-operated online service does not automatically revoke rights you hold under an applicable open-source license to software already lawfully obtained.
50. Termination by the User
You may stop using OpenMindAI at any time.
You may uninstall the application, disconnect connected services, delete local data, remove models, revoke device permissions, and stop using online features.
Uninstalling the application does not necessarily delete project folders, exported artifacts, backups, external storage, or data retained independently by connected third-party providers.
51. Termination or Restriction by OpenMindAI
Where OpenMindAI provides online services, OpenMindAI may restrict or terminate access to those services if you materially violate these Terms, create a serious security risk, abuse infrastructure, violate law, or create significant risk to users or third parties.
Where reasonably possible, OpenMindAI should use proportionate measures.
Termination of optional services does not override rights granted to you by an applicable open-source license for independently licensed software.
52. Disclaimer of Warranties
To the maximum extent permitted by applicable law, OpenMindAI and related services are provided on an "AS IS" and "AS AVAILABLE" basis.
OpenMindAI does not warrant that:
- every feature will be uninterrupted;
- every model will be accurate;
- every generated result will be correct;
- every model will run on every device;
- every third-party service will remain available;
- every generated file will meet your requirements;
- every code change will be secure or bug-free;
- every research answer will be complete;
- the application will be free of all defects.
This disclaimer does not exclude warranties or statutory guarantees that cannot legally be excluded.
Apache License 2.0 and other third-party licenses may contain their own warranty disclaimers for the software components they cover.
53. Limitation of Liability
To the maximum extent permitted by applicable law, OpenMindAI will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of or inability to use the application or related services.
Examples can include loss of profits, business interruption, loss of data, loss of reputation, failed deployment, corrupted project files, incorrect AI output, or unavailable third-party services.
This limitation does not apply where liability cannot legally be limited, including certain liabilities for intentional misconduct, gross negligence, personal injury, mandatory consumer rights, or other non-excludable obligations depending on jurisdiction.
If applicable law does not permit a particular limitation, that limitation applies only to the maximum extent legally permitted.
54. Indemnity Where Permitted
To the extent permitted by applicable law, business or organizational users may be responsible for claims, losses, or costs arising from their unlawful use of OpenMindAI, violation of third-party rights, unauthorized access to systems, or material breach of these Terms.
This section does not apply where consumer law prohibits such an obligation or where the claim results from OpenMindAI's own legally attributable misconduct.
55. Mandatory Consumer Rights
Nothing in these Terms excludes or limits rights that cannot lawfully be excluded.
Consumers may have mandatory rights relating to digital content, software quality, conformity, remedies, refunds, cancellation, privacy, product safety, or unfair contract terms.
Those rights can vary by country.
If these Terms conflict with a mandatory consumer right, the mandatory right prevails.
56. No Reliance on a Specific Model or Feature
OpenMindAI can change model catalogs, model names, download sources, runtimes, integrations, or feature availability.
Do not build a critical business dependency on the assumption that a particular third-party model or provider will remain available forever.
A model can be removed or changed because of licensing, technical, safety, hosting, compatibility, or upstream decisions.
OpenMindAI does not guarantee a permanent model catalog.
57. Changes to These Terms
OpenMindAI may update these Terms when the product, law, platform requirements, business model, or services materially change.
The "Last Updated" date should be changed when a new version is published.
For material changes affecting existing users, OpenMindAI should provide reasonable notice where required.
If applicable law requires renewed consent, OpenMindAI should obtain that consent instead of relying solely on passive publication.
Changes to these Terms do not retroactively remove rights already granted under an applicable open-source license.
58. Governing Law and Jurisdiction
These Terms are governed by the law that validly applies to the OpenMindAI publisher and the user relationship, subject to mandatory consumer-protection and conflict-of-law rules.
Because OpenMindAI may be distributed internationally, this Terms template intentionally does not name a specific governing jurisdiction without confirmed publisher legal-establishment details.
Before commercial publication, this section should be completed with the correct publisher jurisdiction after legal review.
Nothing in this section deprives a consumer of mandatory protections available under the law of the consumer's habitual residence where those protections apply.
59. Dispute Resolution
Before starting formal proceedings, users and OpenMindAI are encouraged to attempt to resolve disputes through good-faith communication where practical.

This does not prevent either party from seeking urgent injunctive relief or using a legally available consumer, regulatory, court, arbitration, or dispute-resolution process.
Do not add mandatory arbitration, class-action waiver, or venue-selection language to the published Terms without jurisdiction-specific legal review.
Such provisions can be invalid or regulated differently across countries.
60. Severability
If a court or competent authority finds part of these Terms invalid or unenforceable, the remaining provisions continue to apply to the extent legally possible.
The invalid provision should be interpreted or limited only as much as necessary to make it lawful where permitted.
61. No Waiver
If OpenMindAI does not enforce a provision immediately, that does not automatically waive the right to enforce it later.
A waiver is effective only where legally valid and clearly given.
62. Assignment
You may have rights to transfer open-source software under the applicable open-source license.
For separate OpenMindAI-operated online services or contractual rights that are not covered by an open-source license, assignment may be restricted where permitted by law.
OpenMindAI may transfer its contractual rights and obligations as part of a lawful restructuring, acquisition, merger, or transfer of the relevant business, subject to applicable notice and consumer rights.
63. Entire Agreement
These Terms, the Privacy Policy, applicable open-source licenses, feature-specific terms, connected-service terms, and mandatory platform terms together form the relevant agreement governing your use of OpenMindAI.
For a specific open-source component, the applicable open-source license controls the rights granted in that component.
For an external provider, that provider's own terms govern its service.
64. Interpretation
Headings are provided for convenience.
Words such as "including" and "for example" are illustrative and not exhaustive.
"OpenMindAI" can refer to the official applications, website, and OpenMindAI-operated services depending on context.
"Local" means processing or storage occurring on the user's own device or user-controlled local environment.
"Connected service" means an external or network-dependent provider or system used through OpenMindAI.
"User" means the individual or entity using OpenMindAI.
65. Contact

Before publication in an app store, the legal developer/publisher name and any required physical or business address should match the information registered with that distribution platform.
